URGENSI PENGESAHAN RUU MASYARAKAT HUKUM ADAT

ABSTRACT

The customary law community is a group of people who have lived for generations in an Indonesian territory because there are ties to ancestral origins, a strong relationship with their homeland where they have customary government institutions and customary law orders. Currently, there are many cases of violence against Indigenous Law Communities, in which there are several indigenous peoples' rights that are not fulfilled. With the cases of violence against the Indigenous Law Community, of course, a law is needed to protect the rights of the Indigenous Law Community. In Indonesia, there is already a law that at least discusses the Indigenous Law Community. However, the existing laws do not provide sufficient protection, and even overlap. Therefore, the government needs to make a new legal regulation by making a Bill on Indigenous Peoples whose contents regulate in more detail related to Indigenous Peoples. This study aims to analyze the urgency of the ratification of the Indigenous Law Community Bill. This analysis is a study that uses a normative juridical approach. The results of this analysis indicate that the Indigenous Law Community Bill needs to be ratified immediately

ABSTRAK

Masyarakat Hukum Adat merupakan sekelompok orang yang secara turun temurun bermukim di dalamsuatu wilayah Indonesia karena ada ikatan pada asal usul leluhur, hubungan yang kuat dengan tanah kelahirannya di mana mereka memiliki pranata pemerintahan adat dan tatanan hukum adat. Saat ini, terdapat banyak kasus-kasus kekerasan tehadap Masyarakat Hukum Adat, di mana terdapat beberapa hak-hak masyarakat adat yang tidak terpenuhi. Dengan adanya kasus-kasus kekerasan terhadap asyarakat Hukum Adat tentunya diperlukan suatu payung hukum untuk melindungi hak-hak Masyarakat Hukum Adat tersebut. Di Indonesia sudah ada payung hukum yang sedikitnya membahas mengenai Masyarakat Hukum Adat. Akan tetapi, payung hukum yang saat ini ada tidak memberikan perlindungan yang cukup, bahkan mengalami tumpang tindih. Oleh karena itu, pemerintah perlu membuat suatu peraturan hukum yang baru dengan membuat RUU Masyarakat Hukum Adat yang isinya mengatur lebih rinci terkait Masyarakat Hukum Adat. Kajian ini bertujuan untuk menganalisis mengenai urgensi pengesahan RUU Masyarakat Hukum Adat. Analisis ini adalah kajian yang menggunakan pendekatan secara yuridis normatif. Hasil dari analisis ini menunjukkan bahwa RUU Masyarakat Hukum Adat perlu segera disahkan.
